Cancellation policy for consumers

 

Consumers have a right of withdrawal in accordance with the following instructions. A consumer is any natural person who concludes a legal transaction for purposes that can predominantly be attributed neither to his commercial nor to his self-employed professional activity (§ 13 BGB).

 

**Withdrawal**

 

You have the right to withdraw from this contract within fourteen days without giving reasons. The withdrawal period is fourteen days from the day on which you or a third party named by you, who is not the carrier, has taken possession of the last goods of the order.

 

In order to exercise your right of withdrawal, you must inform us (ARTE ANDINO, Hauptstr. 20, 96117 Memmelsdorf, Germany, e-mail: [email protected], telephone: +49 (0) 951 180 71 82, fax: +49 (0) 951 9683 0380) of your decision to withdraw from this contract by means of an unequivocal statement (e.g. a letter sent by post, fax or e-mail). You can use the attached model withdrawal form for this, but it is not mandatory.

 

To comply with the cancellation period, it is sufficient that you send the notification of the exercise of the right of cancellation before the expiry of the cancellation period.

 

**Consequences of withdrawal**

 

If you withdraw from this contract, we shall reimburse you all payments we have received from you, including the delivery costs (with the exception of the additional costs resulting from the fact that you have chosen a type of delivery other than the cheapest standard delivery offered by us), without undue delay and at the latest within fourteen days from the day on which we received the notification of your withdrawal from this contract.

 

**Repayment Methods:**

 

For this repayment, we will always use the same means of payment that you used for the original transaction. This includes online payment services such as PayPal, as long as they were used for the original transaction. An exception applies to direct credit card payments, where we reserve the right to make the reimbursement in another way agreed with you that is free of charge to you. In no case will you be charged any fees for this repayment.

 

We may refuse to refund until we have received the goods back or until you have provided evidence that you have returned the goods, whichever is the earlier.

 

You must return or hand over the goods to us without undue delay and in any event no later than fourteen days from the day on which you inform us of the withdrawal from this contract. The deadline is met if you send the goods before the expiry of the fourteen day period.

 

**You will be responsible for the direct costs of returning the goods.**

 

They only have to pay for any loss in value of the goods if this loss of value is due to handling of them that is not necessary to check the nature, characteristics and functioning of the goods.

 

**Exclusion or premature expiry of the right of withdrawal**

 

The right of revocation does not apply to contracts for the delivery of goods that are not prefabricated and for the production of which an individual selection or determination by the consumer is decisive or which are clearly tailored to the personal needs of the consumer (§ 312g para. 2 no. 1 BGB).

 

This applies in particular:

* Hats that are made or customized at your explicit request in a size not offered in the standard range online.

* Hats that are made or customized at your explicit request in a color or color combination not offered online in the standard range (this also includes the additional cost of a hat band of a different color individually modified for you).

* Hats in which an optional customization, such as the silicone reinforcement ("hat opening"), has been added at your own request.

* Montecristi hats, provided that their size, shape or specific details are made individually according to your order and they are therefore considered to be goods made according to customer specifications.

 

When ordering such individualized products, which are manufactured according to your specific specifications, the statutory right of withdrawal does not apply.

**Exchange Option & Resizing (Service Volontario)**

 

In addition to your statutory right of withdrawal, we offer you the option of an exchange of products under certain conditions. Please note that this option does not apply to goods that are excluded from the statutory right of withdrawal (see above, e.g. custom-made hats).

 

**General exchange conditions:**

If the item you ordered is not excluded from the statutory right of withdrawal, you can ask us for an exchange in the event of a size or color request. The direct costs of returning the item you wish to exchange are borne by you. **We will cover the shipping costs for sending the new, exchanged item to you once.** If further exchange processes are necessary for the same order, the regular shipping costs for reshipping to you will apply.

 

**Special regulation for size exchange of hats:**

We want to make sure that your hat fits perfectly. If you request a size exchange for a hat that is not excluded from the right of withdrawal and have measured and communicated your head circumference to us in advance according to our instructions, **we will bear both the costs of returning the too small/large hat to us and the costs of shipping the new hat in the corrected size to you.** This more generous assumption of costs in the case of size exchange is only once per hat under the condition of the prior head measurement in accordance with Guidance possible.

 

**Procedure for exchanges:**

Please contact us before returning to discuss the exchange request and to clarify the availability of the desired item.

**Instructions for correct head measurement**

 

To determine the correct hat size and avoid future size problems, we ask you to carefully measure your head circumference as follows:

 

1. Take a flexible tape measure (or a string and folding rule if necessary).

2. Place the measuring tape about a finger's width above your ears and over the middle of your forehead. This is usually the area where the hat will sit later.

3. Tighten the tape measure, but not too tight, around your head. Make sure that it runs parallel to the ground.

4. Read the value in centimeters. If necessary, measure several times to be sure.

5. Let us know the measured value if you need a size consultation or request an exchange because of the size.
